Un anarchiste que je viens de rencontrer m'a qualifié l'œuvre de la nuit du 4 août 1789 comme la première constitution de la France. La monarchie, par définition n'aurait eu aucune constitution, vu que le pouvoir personnel du roi était, ainsi mon interlocuteur, la seule règle, selon l'adage de Louis XIV: "L'état, c'est moi!"
Une première observation: ça aurait fait le monarche toutpuissant dans le territoir seulement si l'état était le seul pouvoir dans le territoir. Il n'était point ainsi.
En effet, une constitution règle, non seulement les modalités du pouvoir de l'état, mais aussi les rélations entre état et regions et communes ou cités et cantons.
Et la France était très décentralisé, surtout avant Richélieu.
Quand au pouvoir central monarchique dynastique, la principe de succession était réglé par la Loi Salique (en vigueur depuis la guerre de 100 ans) et son nature essentielle par l'adage disant qu'en France c'est le roi qui jouit du pouvoir impérial (romain): ce que nous renvois aux décrets qui formaient la constitution impériale romaine, qui étaient (comme la traduction de la loi salique) en Latin.
Le pouvoir legislatif était partagé entre roi et les parlements qui devaient appliquer les lois: chaque parlement régional pouvait refuser d'enrégistrer une loi royale qui deplaisait.
En plus, tout comme l'Empire Romain et encore Allemagne (mais d'avantage), la constitution de la France était fédérale. En Pompeii il se trouvait mainte inscription avec les sigles SPQP/Senatus Populusque Pompeiorum; les pompeiens étaient à la fois citoyens de Pompei et de Rome impériale. Telle demeurait la rélation essentielle entre pouvoir central et local citadin. Depuis Charlemagne ou avant (c à d avant l'invention de la langue française écrite) il y avait qqc de parallèle pour les cantons rurales, qui, en plus étaient des démocraties directes, comme les cantons de Suisse, sauf en matière de la haute jurisdiction, des que les paysans étaient libres (ce que la plupart était avant la Révolution).
Enfin, la noblesse représantait chaqu'un sa comté ou pareil, et les privilèges sont les echecs régionales d'extendre le pouvoir central: la preuve donc que celuici n'était point invincible ou irresistible.
Cela veut biensur dire aussi, que chaque privilège était une constitution locale, octroyée par le roi.
